What are federal cases?

Under the Tucker Act, the United States also waived immunity to many contract violations by the government. 

  • Diversity Jurisdiction – This refers to the ability of the federal court to take jurisdiction over a case. For this to happen, the jurisdictional amount must exceed $75,000 and no plaintiff can share a state of citizenship with the defendant. You will see these cases arise when someone has filed a lawsuit against, or is facing a lawsuit by, someone from another state or country. 

  • Supplemental Jurisdiction – This refers to the authority of the United States federal courts to hear claims that are related to the original claim in front of them even though they would otherwise lack the jurisdiction to hear the claims independently due to a lack of subject matter jurisdiction. In short, you could find yourself in federal court even though you did not think your case fell under their jurisdiction.
