How am I Protected?

However rocky our nation’s history has been concerning human and civil rights over the last century, the groundwork for protections was laid with the Civil Rights Act of 1871. With that, we gained federal statute 42 U.S.C. § 1983. 

You will often hear to this referred to as Section 1983 for short, and it is a very powerful tool that can be used by people whose rights have been violated by those acting “under color of” law.

What Exactly does the “under color of” Clause Mean?

This clause has come to mean that anyone that is acting under the authority of state (meaning federal or state) law can be held accountable for civil and human rights violations they commit. There does not necessarily have to be any violence involve for this clause to be used in a lawsuit. However, we often see it used in cases of police brutality.

This statute can also be used to uphold a person’s rights concerning laws related to the Civil Rights Act, the Americans with Disabilities Act (ADA), and the Fair Housing Act.

  • Whether the perpetrator was an agent of the state

  • Whether the perpetrator violated “clearly established” rights of an individual or group of individuals
